The petitioner is the widow daughter of Late Maheswar Singha, who was an Assistant Teacher under DPSC, Paschim Medimipur. He retired on 31st July, 1974. He died on 22nd May, 1995. The petitioner's mother was receiving pension in terms of PPO dated 11th November, 2014. The petitioner's mother died on 6th September, 2019.

The petitioner's husband died on 18th January, 2020. The petitioner applied for pension in terms of the decision dated 20th June, 2023 passed by the Special Bench of this Court in MAT 1518 of 2019 (The State of West Bengal & others Vs. Sabita Roy). The D.I. of School found that the petitioner's income was higher than Rs.3,000/- in view of the circular dated 17th October, 2022. The petitioner has annexed a certificate dated 26th September, 2022 issued by Kharikamathani Gram Panchayat, Nayagram Block, Jhargram indicating that the monthly income of the petitioner is Rs.3,000/- and

that she belongs to BPL family.

The minimum income for qualifying as BPL in terms of a decision of a co-ordinate Bench of this Court is required to be about 9,000/-. This is incorporated with WBSR.

Under these circumstances, this Court directs the D.I. of School (P.E.), Jhargram to forward the papers of the petitioner including the documents of identity, death certificate of her husband to the DPPG, West Bengal within a period of three weeks from date of receipt of a copy of this order along with a copy of the writ petition. The petitioner may furnish any other documents to the D.I. for verification of her status and identity. The D.I., Jhargram shall forthwith furnish a report to the DPPG, West Bengal who shall issue PPO to the petitioner.

Let a copy of this order be served along with a copy of the writ petition to the D.I. of Schools, Jhargram and DPPG, West Bengal for necessary compliance. 6.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
