The petitioner submits that pursuant to the order of this Court on August 31, 2021, the Panchayat authority called the petitioner for a hearing on the allegation contained in the writ petition with regard to the illegal installation of a tube well in the premises of the petitioner.
The learned advocate for the Panchayat authority submits that the hearing has been given and concluded but the final order is yet to be passed.
Having heard the rival contentions of the parties, the writ petition is disposed of with a direction upon the Panchayat authority to pass a reasoned order within a period of two weeks from date and communicate the same to the petitioner within a week thereafter.
As the hearing has been concluded and the petitioner submits that no further hearing would be necessary. The
Panchayat authority shall pass the order in accordance with law on the basis of the hearing given and upon dealing with the contentions of the petitioner in the written submission filed by the petitioner before the Panchayat authority. As the respondents have not been called for to file their affidavits, the allegations are deemed to have been denied. The order shall be communicated within four weeks from date. Accordingly, the writ petition is disposed of. However, there will be no order as to costs.
All the parties are directed to act on the basis of the learned advocate's communication.
