The petitioner, in this case, filed an application under Section 12 of the Protection of Women from Domestic Violence Act, 2005 before the learned Judicial Magistrate, 1st Court, Tamluk, Purba Medinipur, in the year 2018.

It appears from the order-sheets annexed to this revisional application that the hearing of the said application has been adjourned for three years on different dates for want of service return from the opposite parties.

An application under Section 12 of the said Act, for monetary relief as prayed for by the petitioner, should have been expeditiously heard by the learned Magistrate in the Court below.

This revisional application is disposed of with a direction upon the learned Judicial Magistrate, First Court, at Purba Medinipur to take necessary steps to ensure the service upon the opposite parties. The learned Magistrate will be at liberty to give a direction for service of the application upon the opposite parties through the local Police Station.

The learned Magistrate shall also make an endeavour to dispose of the Misc. Case No. 481 of 2018 within a period of nine months from the date. Since the opposite party nos. 1 to 8 will not be prejudiced by this order, this application is disposed of without notice upon them.

The revisional application being 1738 of 2021 is disposed of.
