1. Learned advocate representing petitioner submits that dispute centers around land in question. Petitioner and private respondents are claiming right over the said land as a result whereof peaceful possession of the land by the petitioner is disturbed prompting the petitioner to approach this Court with the present writ petition and seeking direction upon the concerned police authorities to protect his right over the land in question.

2. It is also submitted that private respondents filed original application before the West Bengal Land Reforms and Tenancy Tribunal (WBLRTT) and said application is pending for adjudication.

3. State respondents are represented by Mr. Das, learned Additional Government Pleader who submits that issue needs to be decided by the appropriate forum.

4. In view of pendency of original application before the Tribunal and issue is concerning right of the petitioner and private respondents over the land in question, Court finds police authority is not the appropriate authority to decide inter se right of the parties over the land in question. Petitioner needs to approach appropriate forum in pursuit of remedy.

5. However, concerned police authorities are directed to maintain peace and tranquility at the locale and to see no untoward incident takes place.

6. Writ petition stands disposed of.

7. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
