Case No. 338/2018 under Section 125 of the Code of Criminal Procedure, 1973, pending before the learned Judicial Magistrate, 3rd Court at Tamluk.

It appears that the petitioner's application for maintenance has not yet been disposed of though the learned Magistrate in the Court below has fixed the date for evidence on different occasions. An application for maintenance requires to be heard expeditiously.

In view of that, this revisional application is disposed of with a direction upon the learned Magistrate in the Court below to consider the prayer of interim maintenance of the petitioner in the light of the judgment reported at 2020 (4) Crimes 291 (SC) (Rajnesh v. Neha) and dispose of the same within a period of four months from date.

With the aforesaid observation, this revisional application being CRR 1784 of 2021 is disposed of.
