The licensed MR Dealer expired on 3rd August, 2009. The petitioners being the sons of the deceased licensee made application for being engaged on compassionate ground in the year 2013.

The learned advocate appearing for the petitioners submits that a separate application was filed by the heirs of the deceased in the year 2009 itself. There is nothing on record to show that application for engagement on compassionate ground was filed prior to 2013.

Law mandates that application for compassionate engagement is to be filed within a period of 60 days from the date of occurrence of vacancy.

That not being filed, no relief can be granted to the petitioners in the instant case.

The writ petition fails and is hereby dismissed. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
