Pradip Kumar Guha Roy Ms. Rupsa Sreemani Ms. Suranjana Bhattacharyya ... for the petitioner This is an application for expeditious disposal of the Title Suit No.261 of 2021 which is pending before the learned Civil Judge (Junior Division), 1st Court, Barrackpore, North 24 Parganas. The suit is for eviction. The petitioner is the plaintiff in the said title suit.

The learned advocate for the petitioner submits that the application under Section 7(2) of the West Bengal Premises Tenancy Act, 1997 along with an application for condonation of delay, have not yet been disposed of. The suit is not proceeding. It is further submitted that a delayed application under Section 7(2) of the said Act was not maintainable. This court is of the view that justice would be subserved if the learned court below is directed to dispose of the pending applications as also the suit, expeditiously.

This court has neither gone into the merits of the applications nor into the merits of the suit. An order of expeditious disposal of any litigation, enures to the benefit of all the parties. Hence, prior service

of this revisional application upon the opposite party would not be necessary. The prayer is innocuous. The revisional application is disposed of with direction upon the learned court below to dispose of the pending applications within a period of two months from the next date fixed and thereafter, make an endeavour to dispose of the suit expeditiously, without granting any unnecessary adjournment to either of the parties. The learned court shall proceed strictly in accordance with law and independently.

The petitioner is directed to serve a copy of this revisional application along with the server copy of this order, upon the opposite party.

Accordingly, the revisional application is disposed of.

All the parties are directed to act on the basis of the server copy of this order.
