Prajapati Saha Mr. Mujibar Ali Naskar, Ms. Piyali Pal ...for the petitioner A direction to secure expeditious disposal of Title Suit No.21 of 2002, pending before the learned Civil Judge (Senior Division), 1st Court, Malda, is the ultimate relief sought for in this case.

Petitioner is a defendant.

The only contention expressed by the petitioner is against the delay caused in the disposal of the suit. No other point is raised requiring address by this Court.

In view of the nature of order proposed to be made in this case, no prior notice is considered to be necessary.

Service upon the opposite party stands dispensed with.

Accordingly, learned Civil Judge (Senior Division), 1st Court, Malda, in Title Appeal No.21 of 2002, is requested to ensure expeditious disposal of pending suit referred above, after causing disposal of

interlocutory application, if there be any pending, providing sufficient opportunity of hearing to either of the parties to this case, but without granting any unnecessary adjournment, unless it is extremely unavoidable.

While endeavouring such exercise, the year of institution of the suit may be taken into account by the court below, and in context thereof, steps may be taken so as to reach logical conclusion of the suit in the best possible manner, preferably within a period of six (06) months from the date of communication of this order.

Petitioner is directed to make communication of this order to the learned court below as well as to the opposite party and her learned advocate in the court below.

With this observation/direction, the revisional application stands disposed of.

Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Subhasis Dasgupta, J.)
