Versus

Pooja Sharma (Via Video conference) Mr. S. E. Huda, Mr. Sayan Ray, Mr. Samrat Choudhury, ... For the Petitioner.

The Court is approached under Article 227 of the Constitution of India soliciting a direction to ensure expeditious disposal of a Matrimonial Suit being MAT Suit No. 9 of 2014 now pending before learned Additional District Judge, 16th Court at Alipore.

Mr. S. E. Huda, learned advocate representing for the petitioner submits that the suit for divorce was instituted in the year 2014, and till such time the suit has not yet proceeded to desirable extent, and thereby adversely affecting the valuable rights of the petitioner/husband, as regards expeditious disposal of the pending matrimonial suit.

Learned advocate for the petitioner is fair enough to bring it to the notice of the Court that there are several Misc cases pending in the Court below inclusive of the prayer for alimony pendente lite and the custody of the child.

The point thus requires to be addressed is very short and simple, requiring no extensive hearing, and the same may even be disposed of without inviting presence of the opposite parties. Service upon the opposite party/wife accordingly

stands dispensed with.

Having considered the submission of the learned advocate for the petitioner, learned Court below is directed to dispose of the pending multiple misc cases expeditiously as possible, providing sufficient opportunity of hearing to either of the parties, without granting unnecessary adjournments, unless it is extremely unavoidable. After disposal of the misc cases, learned Court below is requested to ensure expeditious disposal of the pending matrimonial suit, so that logical conclusion of the matrimonial suit for divorce may be reached at an early date.

Petitioner is directed to communicate this order to the opposite party/wife and her learned advocate, so that both the parties may come prepared ready for effective utilisation of date or dates fixed by the learned Court below.

With these directions and observation the revisional application stands disposed of.

There shall be no order as to costs.

Urgent phostat certified copy of the order, if applied for, be given to the appearing parties as expeditiously as possible on compliance of all necessary formalities.
