The petitioner in the writ petition has prayed for cancellation and or setting aside the impugned notice of e-auction dated May 24, 2023.
It appears from the submissions made on behalf of the parties that the said e-auction notice was not proceeded with any further by the respondent authority. Fresh e-auction notice was issued and the said auction stood concluded on December 30, 2023. As it appears that the cause of action for filing the present writ petition does not survive any further, accordingly, there is no requirement of proceeding with the instant writ petition any further.
The writ petition and the connected application stand disposed of.
It will be open for the petitioner to challenge the subsequent order passed by the Panchayat Samity, if permissible in law.
