Learned advocate appearing for the petitioners submits that the total recovery in the present case is 686 bottles of phensedyl. There are six accused persons and the charges have already been framed. Two of the witnesses have been examined and the petitioners are in custody for eight months.

Learned advocate appearing on behalf of the State opposes the prayer for bail as commercial quantity of contraband has been seized.

I have taken into account the time period for which the petitioners are in custody as well as the time which will be required for taking the trial to its logical conclusion and also the factum that there is no criminal antecedents (except cases on which three of the accused persons were implicated on the basis of statement of co-accused). As such, I am inclined to release the petitioners on bail. 4.

Accordingly, the prayer for bail of the petitioners is allowed.

As such, the petitioners, namely, 1. Monirul Sk @ Manarul Sk @ Manirul Sk, 2.Ramjan Sk, 3.Fulsar Mallick, 4.Amrul Islam and 5.Shahalam Islam @ Saha Alom Islam shall furnish bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court, NDPS Act, 5th Court at Berhampore, Murshidabad.

If on bail, the petitioners shall be physically present on each and every date before the learned Trial Court in seisin of the case. The petitioner shall not leave the district of Murshidabad without prior permission of the concerned Court.

Accordingly, CRM(NDPS) 1330 of 2026 is disposed of. 8.

Case diary be returned to the learned advocate appearing for the State.

All parties shall act on the basis of server copy of this order duly downloaded from the official website of this Court.

10. Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
