The petitioner retired on 30th September, 2022 as a Principal from the Institute of Pharmacy, Jalpaiguri Netaji Subhas Chandra Bose Road Hospital, respondent no. 7 in this writ application.
It is the case of the petitioner that till date he has not received his retiral dues including pension and gratuity.
Mr. Sudipto Panda, learned advocate appearing for the State submits that following an order passed by this Court in a Public Interest Litigation being WPA (P) no. 35 of 2021, an audit was conducted by the Comptroller and Auditor General of India, and it was found that there had been a financial defalcation to the tune of Rs. 1 crore 80 lakh.
He submits that the petitioner was working as a Principal in the said institution at that relevant point of time. He, further, submits that the next hearing of the
said Public Interest Litigation has been fixed on August 9, 2022.
Since the issues involved in this case are related to the subject matter of the Public Interest Litigation pending before a Division Bench of this Court, I am not inclined to entertain this writ petition.
However, dismissal of the writ petition shall stand in the way of the petitioner to approach the said Division Bench as to take any steps in accordance with law for redressal of his grievance.
Accordingly, WPA 12786 of 2022 is dismissed.
Let urgent certified copies of this order, if applied for, be given to the parties upon compliance with all the necessary formalities.
