1. Affidavit of service filed in Court is taken on record.

2. The writ petitioner is aggrieved by order dated 7th September, 2023 passed by the Assistant Director, Pension, Provident Fund and Group Insurtance, Govt. of West Bengal, declining pension to her based on the memorandum dated 1st November, 2010.

3. It is now well settled by a decision of a three Judges Bench of this Court that an unmarried daughter is entitled to pension.

4. Counsel for the State submits a report of D.I. of Schools, Primary Education, Purulia dated 13th June, 2024, which is taken on record.

5. It appears that the documents have been sought from the petitioner and the same have been submitted. The concerned D.I. of Schools is processing the petitioner's application for family pension.

6. It is ordered that the concerned D.I. of Schools shall process the same within three weeks from date. Any further document, if required from the petitioner,

may be supplied by her. The D.I. of Schools, Primary Education, Purulia shall thereafter submit a report to the DPPG, West Bengal, based on which, the DPPG, West Bengal shall issue pension payment order to the petitioner from 1st January, 2022.

7. Let arrears be paid by the DPPG, West Bengal within three months from issuance of PPO.

8. With the aforesaid observations, the writ petition is disposed of.

9. There will be no order as to cost.

10. All parties are to act on a server copy of this order duly downloaded from the official website of this court.
