Aforesaid three writ petitions are taken up for consideration pursuant to the order dated 22nd August, 2023 in presence of the learned advocates representing the petitioners in all the writ petitions, State-respondents in the writ petition being WPA 137 of 2016 and Non
Governmental Organisation (NGO) namely Gana Unnayan Parishad. State respondents in the writ petition being WPA 25692 of 2017 is also represented by learned advocate.
Petitioners are claiming to have been engaged as District Level Trainers (Coordinators) and Block Level Trainers (Co-facilitators) in the district of Murshidabad. Though writ petitions were instituted primarily challenging notice dated 24th June, 2016 issued by the concerned respondent authorities whereby it has been alleged that in place of the petitioners another group of candidates were attempted to be inducted as District Level Trainers (Coordinators) and Block Level Trainers (Co-facilitators), but today the learned advocate representing the State respondents submits that the said notice dated 24th June, 2016 will not be implemented since issuance of subsequent memorandum dated 23rd June, 2022 whereby it has been decided by the authorities that Block Programme coordinators (ASHA) would be appointed under the relevant scheme.
petitioners is whether petitioners were engaged upon observance of the procedure as contemplated under the said memorandum dated 24th April, 2007 or not. It has been submitted by the learned advocate representing the Non Governmental Organisation (NGO) namely Gana Unnayan Parishad that petitioners were not appointed following the procedure as contemplated under memorandum dated 24th April, 2007 rather they were trained by the Non Governmental Organisation (NGO) namely Gana Unnayan Parishad for providing such training the NGO was paid by the state authorities. Mr. Partha Sarathi Bhattacharyya, learned senior advocate representing the petitioners prays for time to clarify the position.
