Having heard the learned advocate for the petitioner and the opposite party no.1, appearing in person, this court does not find that the order impugned requires interference by this court. The learned court below has fixed October 17, 2023 as the next date of the suit. The suit shall proceed expeditiously.

The pending applications shall be disposed of urgently. If the petitioner is aggrieved by the action of the defendants in the suit with regard to obstruction from user of the privy, it is for the petitioner to approach the learned court below and pray for preponement of the date by filing a put up petition.

This court has neither gone into merits of the suit nor into the case and counter case of the parties.

All the pending applications and the suit should be disposed of expeditiously and strictly in accordance with law.
