The petitioner is desirous of holding a public meeting at Rajarampur under the Habibur Police Station in the District of Malda on June 12, 2023. Prior thereto, another writ petition for holding a public meeting at the same venue on an earlier date was initially granted and subsequently revoked for being short of the notice period of 15 days. The writ petition challenged the said rejection and/or revocation of permission in vain.

When the instant writ petition was in the process of being filed with change of dates, the petitioner received a notice on Whatsapp on June 6, 2023 from the Habibur Police Station, seeking several clarifications and/or permissions.

Having considered the communication of the Habibur Police Station, this Court is of the view that it is difficult for the petitioner to comply with and answer each and every one of the queries to the satisfaction of the Habibur Police Station.

The names of three persons responsible for compliance with security, safety and the general well-being of the participants in the public meeting shall be specified to the police by the petitioner.

It is expected that the contractor who shall make the stage and the electrician to provide electrical facilities, have appropriate certification and licences. Such licences may be produced before the police. The other conditions may be complied with by the petitioner to the extent possible. 6.

copy of the diagram map indicating compliance of point no. 1 and 2 has been supplied to the counsel for the State. The same may be supplied to the Habibur Police Station as well.

The petitioner may hold their public meeting peacefully and ensure that no untoward incident takes place.

The police shall effect necessary deployment in accordance with law.

9.

The venue of the meeting shall be cleaned up after the conclusion of the same.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

12.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
