July 25, 2025 26 ARDR CRM (M) 704 of 2025 In Re : An Application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Jamboni Police Station Case No. 15 of 2024 dated 19/2/2024 under Sections 447/386/34 of the Indian Penal Code and Sections 25(1B)/25(6) of the Arms Act.
And In Re :
Balak Soren @ Balak Saren @ Balak Chand Saren ... petitioner.
Adv. Sanjit Kumar Dan ...for the petitioner.
Adv. Soumik Ganguly, Adv. Debanshu Ghorai, ...for the State.
Status report submitted by the State is taken on record. The petitioner is in custody for about one year and six months and prays for bail.
Learned counsel for the State opposes the prayer and submits that vulnerable witnesses are yet to be examined. I have considered the material on record.
Witnesses have implicated the petitioner in the alleged offence in their statements recorded under Section 161 of the Code of Criminal Procedure. The offending firearm has been recovered at the instance of the petitioner. Vulnerable witnesses are yet to be examined. In the event the petitioner is released on bail at this stage, likelihood of winning over/intimidating the witnesses cannot be ruled out.
In view of the above, the prayer for bail is rejected at this stage. The learned trial Court is directed to examine the vulnerable witnesses at the earliest.
The application for bail is disposed of.
Case Diary be returned.
Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
