Petitioner would deposit a cost of Rs.50,000/- with the Treasury of the learned Additional District Judge, Fast Track, 5th Court, Barasat or any authority to be directed by the said court within 3rd July, 2023.

Report submitted by Mr. Tanmoy Kumar Ghosh, learned advocate appearing for the State reflects that Dr. Soumitra Dalal, Ex-EMO of Sambhunath Pandit Hospital has informed him that it would be convenient to depose before the learned court on 03.07.2023 to 07.07.2023 or from 25.07.2023 to 31.07.2023. Let the report be kept with the record.

Accordingly, the petitioner would take steps so that the cost is deposited by 11.30 a.m. on 3rd July, 2023. Learned trial court would fix a date according to the convenience expressed by the doctor.

Learned trial court would recall the witness. The inspector-in-Charge, Barasat Police Station would as

per the report immediately make arrangement for availability of the doctor. All efforts must be taken to complete the examination-inchief and cross-examination on the same date when the doctor appears before the learned trial court.

With the aforesaid observations, CRR 2056 of 2023 is disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
