Learned counsel for the petitioner submits that since the said order is amenable to appeal under Rule 51 of the Minor Minerals (Concession) Rules, 2016, the petitioner be granted liberty to approach the appellate forum for redressal.

In view of the above, the writ petition being WPA No. 12820 of 2022 is disposed of.

Liberty is granted to the petitioner to approach the appropriate forum for redressal of his grievance. In the event the petitioner prefers statutory appeal within one month from date, the appellate authority shall deal with the appeal on merits without dismissing the same on the ground of limitation.

There shall be, however, no order as to costs.
