Learned counsel appearing on behalf of the West Bengal State Electricity Distribution Company Limited (WBSEDCL) submits that the petitioner was asked to appear by May 13, 2025, for the purpose of finalizing the assessment. However, the petitioner failed to appear on the stipulated date.

WBSEDCL further prays that a fresh date of hearing be scheduled to enable the petitioner to be heard, following which a final order of assessment may be passed. In light of the foregoing, this writ petition is disposed of with a direction to the petitioner to appear before the concerned assessing officer on July 1, 2025, at 2:00 p.m. It is hereby clarified that no separate notice shall be issued to the petitioner by the assessing officer.

Should the petitioner fail to appear on the

aforementioned date, the assessing officer shall proceed to pass a final order of assessment ex parte, in accordance with the law.

Accordingly, WPA 12902 of 2025 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
