Mr. Santanu Maji Mr. Subhayu Das .....for the petitioner Mr. Malay Krishna De ......for the State Mr. Avishek Prasad ....for the DPSC, Malda 1) Affidavit of service filed on behalf of the petitioner is taken on record.

2) Petitioner, inter alia, has prayed for transfer on the ground of distance in between present school of the petitioner and her place of residence and it is also submitted that she is surplus teacher in her present school.

3) Application for transfer was made on 13th March, 2025 in off-line mode addressed to the Chairman, District Primary School Council, Malda being respondent no. 6.

4) It is submitted that petitioner has completed five years of service as confirmed teacher. Therefore, there is no impediment in

transferring the petitioner from one school to another school within same district.

5) District Primary School Council, Malda and State respondents are represented by learned advocates.

6) Having considered the submissions made on behalf of the parties, writ petition stands disposed of directing respondent no. 6 to decide transfer application of the petitioner dated 13th March, 2025 by six weeks from date of communication of this order in accordance with law. Decision to be taken by respondent no. 6 shall be communicated to the petitioner by fortnight thereafter.

7) However, transfer application of the petitioner shall not be rejected on the ground of suspension of Utshasree portal.

8) There shall be no order as to costs.

9) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
