Mr. Satadal Sovan Halder .............for the petitioner Mr. Supriyo Chattopadhyay Ms. Sayantanee Bhattacharjee ..........for the State The writ petitioners were appointed as contractual teachers in Kaylapara S.D. High School (H.S.), South 24 -Parganas, in vocational stream vide appointment letters dated 2nd July, 2012 and 1st July, 2012. The said appointment letters say that the posts, where the writ petitioners were appointed on contractual basis, were for computer teachers. It is submitted by Mr. Halder, learned advocate representing the writ petitioners, that after appointments of the writ petitioners in the year 2012, they continued in the said posts of contractual teachers in Kaylapara S.D. High School (H.S.) till 2014 and thereafter they were discontinued by the concerned authority of the said school. Now the writ petitioners have made applications before the Headmaster of
Rajnagar Srinathgram Bani Vidyapith (HS), South 24 -Parganas for appointments in the suitable posts in vocational stream which were not considered by the Headmaster of the said school though certain posts are lying vacant.
The State is represented by Mr. Supriyo Chattopadhyay, learned Senior Government Advocate, ably assisted by Ms. Sayantanee Bhattacharjee, learned advocate.
This Court has considered the submissions of the learned advocate representing the writ petitioners and perused the records carefully. No formal notification or advertisement has been placed before this Court wherefrom this Court can ascertain that whether there was at all any recruitment process initiated by the concerned authority of Rajnagar Srinathgram Bani Vidyapith (HS), District -South 24 Parganas. In absence of due selection process initiated by Rajnagar Srinathgram Bani Vidyapith (HS), simply by making applications before the Headmaster of the said school praying for appointments in the posts of contractual teachers, no right is accrued on the writ petitioners for considerations of their candidatures by the said school authority even vacancies are available in vocational stream. Since no right accrues in favour of the writ
petitioners for consideration of their candidatures for the post of contractual teachers in Rajnagar Srinathgram Bani Vidyapith (HS), the writ petition is dismissed without any order as to costs.
