The compliance report filed by Mr. Mahata, learned advocate for the State, is taken on record. It appears that apart from gratuity, all other admissible dues of the petitioner, namely, leave salary and the pension including the arrears have been paid.

With regard to the payment of gratuity, the petitioner is granted liberty to approach the Director of Pension & Provident Fund and Group Insurance in accordance with law.

It is the specific case of the alleged contemnor that unless the Director of Pension & Provident Fund and Group Insurance issues the pension payment order, the release of gratuity cannot be made. The alleged contemnor does not have any role to play in the release of the said amount.

Under such circumstances, the contempt application is disposed of. The contempt proceedings are dropped.

There shall be no order as to costs.

Parties are to act on the server copy of this order.
