The principal amount on account of ex gratia has already been paid to the petitioners. The petitioners now claim interest on the delayed payment of ex gratia. The issue has already been decided in favour of the petitioners by virtue of a decision of the Hon'ble Division Bench dated January 18, 2023 In the matter of : the State of West Bengal & Ors. Vs.

Habibur Rahman Halder and Others rendered in MAT 2093 of 2022.

Following the direction of the Hon'ble Division Bench, the respondents shall pay interest to the petitioners, upon verification of records, at the rate as directed by the Hon'ble Division Bench to the petitioners from the date when the ex gratia became payable to the individual petitioners till the date of actual payment made to the individual petitioners.

In the event, any assistance is required from the petitioners, the petitioners shall render all such assistance to the respondents.

The entire exercise as directed herein including making payment of interest to all the individual petitioners by crediting their respective bank accounts shall be carried out by the respondents positively within a period of ten weeks from the date of communication of this order.

Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.

With the above observations and directions this writ petition W.P.A. 13079 of 2025 stands allowed, without any order as to costs.
