The petitioner challenges an order of sale under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 issued by the respondent no.4.

S.A. No. 542 of 2022 has already been filed before the Debts Recovery Tribunal-III, Kolkata under Section 17 of the SARFAESI Act, 2002.

This Court is of the view that the petitioners may pursue and seek preponement and urgent hearing thereof, if so advised.

In view of the aforesaid observations, the instant writ petition shall stand disposed of without any order. 5.

In view of the disposal of the main writ petition, the connected application being CAN 1 of 2023 shall also stand disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
