Ganguly ...for the State Mr. Subhasis Bandopadhyay ...for Municipality 10-12-2024 AKG Ct. 15 The petitioner raises the grievance that respondent no. 10 has undertaken unauthorised construction at Holding No. 112, Ward No. 15, under the Burdwan Municipality.

On the other hand, the learned advocate for respondent no. 10 submits that the original plot was numbered as 112, which was subsequently subdivided into two plots, 112/A and 112/B. Respondent no. 10 purchased plot 112/B and, thereafter, constructed a building after obtaining a sanctioned plan from the Corporation.

The Corporation does not dispute that respondent no. 10 constructed the building in accordance with the sanctioned plan on plot no.112/B. In light of the above, the allegations raised by the petitioner cannot be entertained.

Accordingly, WPA 14282 of 2024 is dismissed.
