Affidavit-of-service filed on behalf of the petitioner is taken on record.

Petitioner has prayed for transfer from one district to another being primary teacher.

However, it is submitted that petitioner was appointed in terms of memo dated 19th July, 2021 as primary teacher and joined the post on 20th July, 2021 whereas application for transfer was made on 1st April, 2025 when petitioner did not

complete five years of service as confirmed teacher. 4.

This Court has considered the issue whether a primary teacher who has not completed five years of confirmed service is eligible for transfer or not in a writ petition being WPA 7329 of 2025 (Priyanka Sarkar v. State of West Bengal & Ors.). It was decided in Priyan Sarkar (supra) that a primary teacher who has not completed five years of confirmed service is not entitled to apply for transfer.

Hence, the present writ petition stands dismissed. 6.

However, there shall be no order as to costs. 7.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
