The instant writ petition is filed seeking a direction upon the Tribunal to dispose of the tribunal application being OA 44 of 2022 on expeditious basis. The next date is fixed on 23rd March, 2023.

It is really unfortunate that the said application was moved under the heading Motion on 4th April, 2022 and securing the status report from the State respondents, the next date is fixed nearly at the advent of one year from the said date.

The purpose of establishing Tribunal is to secure speedy disposal of the cases. If the matter is grappling at the Motion stage and the manner in which the dates are fixed shall percolate the sense in the mind of the litigant that the purpose and object for which the Tribunal has been established would be totally frustrated.

We do not intend to go much deep into the aforesaid aspect except that the sense of responsibility must be percolated into the Tribunal so that the matter may be fixed at a short interval in order to ensure the speedy disposal.

Mr. Dey, learned Additional Government Pleader, is present in Court today. He has communicated that the State would be responsive to file the status report as directed by the Tribunal within a short span of time.

In view of the above, the State is directed to submit the status report on or before the last date of the month of November, 2022 before the Tribunal. The Tribunal is requested to fix the date in the first week of December, 2022 and ensure that the matter is expeditiously disposed of by fixing the dates at a short interval and not in the manner as is evident from the impugned order.

With the above observations the writ petition is disposed of.
