The petitioner alleges that the respondent no. 4 was taking steps to encroach upon the private land of the petitioner and start making construction thereon. None appears on behalf of the respondent no. 4 despite service.

Affidavit-of-service filed in Court today is taken on record.

Learned advocate representing the Rajpur Sonarpur Municipality submits that the petitioner never filed any objection before the Municipality highlighting her grievances.

The Court is of the opinion that as regards the allegation of encroachment of private property, the Municipality will not be the competent authority to decide the issue.

It will be open for the petitioner to approach the proper forum for relief, if so advised.

The writ petition stands disposed of.
