Learned advocate for the petitioners submits that the private respondent no.4 misappropriated the assets of the hotel and is also engaged with some miscreants for constructing a shop in front of the hotel/resort.

To that effect, information was furnished with the police authorities.

However, the police authorities, till date, refused to take any action.

Having considered the plight expressed by the petitioner and the nature of the dispute complained of, I grant liberty to the petitioners to approach the jurisdictional Magistrate under Section 175(3) of the BNSS.

The learned Magistrate would assess and ascertain regarding the nature of the criminal offence, thereafter, pass necessary directions as it deems fit and proper.

With the aforesaid observations, WPA 13048 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the petitioner.
