(A) 2206 of 2023 12.06.2023 Sl. 95 Court No. 29 sdas (Allowed) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed in connection with Dhantala Police Station Case No. 252 of 2023 dated 09.04.2023 under Sections 376/417/420/506/34 of the Indian Penal Code.

1. Heard learned Counsel for both the parties.

2. Investigation is stated to have progressed substantially. Victim lady is stated to be a married lady with one son and there is stated to be consensual relationship between two persons.

3. Regard being had to such facts and submissions, factum of permanent residence of the petitioner, non-requirement of custodial interrogation of the petitioner in the present case and substantial progress in the investigation, it is directed that the petitioner shall be released on bail by the Arresting Officer in the event of his arrest on such terms and conditions as deemed just and proper in the facts and circumstances of the case in connection with Dhantala P.S. case No. 252 of 2023 dated 09.04.2023 including the conditions that i) the petitioner shall appear before the I.O. once in a week on the day and time fixed by the I.O. till the submission of Final Form; ii) he shall not threaten or induce or coerce any witnesses of this case in any manner whatsoever.

4. Within 15 days from today, the petitioner is directed to appear before the I.O. with a server copy or certified copy of this order.

5. Accordingly, the prayer for the anticipatory bail is allowed.
