Learned senior advocate appearing for the petitioner submits that the petitioner was falsely implicated in the instant case. There was a love relationship in between the petitioner and the victim girl.

Learned advocate appearing for the State draws the attention of the Court to the injury report and to the statements recorded under Section 164 of the Code of Criminal Procedure. He also submits that police are yet to conclude the investigation. Considering the materials available in the case diary and considering the statements recorded under Section 164 of the Code of Criminal Procedure and considering the fact that police are yet to conclude the investigation, we are unable to grant bail to the petitioner at this stage.

Accordingly, prayer for bail is rejected and the application being CRM 5778 of 2021 is dismissed. (Debangsu Basak, J.) (Ananda Kumar Mukherjee, J.)
