The petitioner was engaged as ASHA. As she got elected as member of the Gram Panchayat and thereafter held the position of Pradhan of the Gram Panchayat, she was not able to perform her duty as ASHA. After the term of Pradhan expired, she expressed her intention to resume duty as ASHA.

It has been submitted that similarly placed candidates were allowed by the authority to resume duty. A representation made on behalf of the petitioner by her learned counsel is alleged to be kept pending.

None represents the respondents despite service. Affidavit of service is on record.

In the absence of the respondents it is not possible for the Court to decide the issue conclusively.

In view of the above, the instant writ petition is disposed of by directing the Chief Medical Officer of Health, Diamond Harbour Health District, South 24 Parganas, the third respondent herein, to consider and dispose of the petitioner's legal

representation dated April 26, 2024 strictly in accordance with law, after giving a reasonable opportunity of hearing to the petitioner for production of documents in support of her stand, at the earliest but positively within a period of twelve weeks from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.

Learned counsel for the petitioner shall forward a copy of the representation at the time of communicating this order.

It is made clear that this Court has not entered into the merits of the representation and that all points are left open to be decided at the time of consideration of the representation.

All parties are to act on the server copy of this order duly downloaded from the official website of this court.

Certified copy of this order, if applied for, shall be made available to the parties.
