It has been submitted by the learned advocate for the petitioners that the present criminal proceeding being G.R. Case No. 1891 of 2019 under Sections 498A/406/323 of the Indian Penal Code, 1860, read with Section 3 & 4 of the Dowry Prohibition Act, 1961, is pending before the learned Judicial Magistrate, 5th Court, Burdwan at Asansol for a long period of time. It has been, further, submitted that after filing of the charge sheet, the case was transferred to the learned Judicial Magistrate and thereafter there has been no effective progress in the proceeding. It appears that till date the charge has not yet been framed by the learned Magistrate, 5th Court, Burdwan at Asansol. The delay in conducting the proceeding cannot be attributed to the learned Magistrate in this pandemic situation. This application is

disposed of with a direction upon the learned Judicial Magistrate in the Court below to make an endeavour to complete the charge hearing within three months from date.

CRR 1728 of 2021 is, thus, disposed of.
