CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 1902 of 2012 In the matter of : Sri Nitai Ghosh & Ors. .....petitioners. In Re : An application under Section 482 of the Code of Criminal Procedure.

The revisional application was preferred challenging the proceedings relating to C. R. Case No. 386/2011 filed under Section 406 of the Indian Penal Code pending before the learned Judicial Magistrate, 2nd Court, Siliguri, Darjeeling. Record of this revisional application reflects that the interim order passed earlier was upto 31st August, 2013 and the same has never been extended thereafter.

Today when the matter has been called on, none appeared on behalf of the petitioners to inform this court regarding the present stage of the proceedings before the learned court.

Having regard to the fact that more than 8 years have already been passed in the meantime and the petitioners approached this court at the stage of initiation of the proceedings, I am of the view that no purpose will be sub-

served by keeping this revisional application pending before this court. The petitioners will be at liberty to agitate the points so canvassed in this revisional application at the appropriate stage of the proceedings provided the complaint case is still pending before the jurisdictional court. . Accordingly, the present revisional application being CRR 1902 of 2012 is disposed of.

All pending applications, if any, in connection with revisional application, are consequently disposed of. All parties are to act on the server copy of this order duly downloaded from the official website of this court. ( Tirthankar Ghosh, J. )
