Dr. Sutanu Kumar Patra, Ms. Supiya Dubey ... for the WBCSSC The D. I. of Schools(S.E.), North 24 Parganas has submitted a report, which is taken on record. There appears to have been inordinate delay in processing of the petitioner's pension papers. There was some issue with regard to the fixation of the petitioner's pay scale in terms of ROPA 2019. The issue was resolved at the end of the D. I. of Schools (S.E.), North 24 Parganas and sent back to the head of the Institution.

It is submitted that the Teacher-in-Charge, Chandpur High School, Rajarhat is sitting tight over the matter.

This Court deprecates the conduct of the Teacher-in-Charge, the D.I. of Schools(S.E.), North 24 Parganas and the D.P.P.G. for the delay in processing the petitioner's pension papers.

The Teacher-in-Charge, Chandpur High School, Rajarhat shall within a period of one week of receipt of a copy of this order process the petitioner's pension paper and forward the same to the D. I. of Schools(S.E.), North 24 Parganas, who shall within a period of one week thereafter transmit the same to the D.P.P.G. The D.P.P.G. shall issue pension payment order within a period of one week thereafter.

Pension shall be released to the petitioner immediately upon completion of 21 days from date. All arrears of pension shall be paid to the petitioner together with interest at the rate of 8 per cent per annum. The Commissioner of School Education is hereby directed to fix accountability for the delay in processing of the petitioner's pension papers and recover 8 per cent interest, as ordered to be paid herein above, from such person. With the aforesaid observations, the writ petition is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
