Mrs. Zainab Khalid v. The Chief Manager, Canara Bank And ORS.
16.08.2023 mb
IN THE HIGH COURT AT CALCUTTA
CONSTITUTIONAL WRIT JURISDICTION APPELLATE SIDE W.P.A. No. 13164 of 2023 Mrs. Zainab Khalid Vs.
The Chief Manager, Canara Bank & Ors.
Mr. Tarique Quasimuddin, Ms. Syed Khafiz Zamar ...for the petitioner Mr. J. Brahmachari, Mr. U.K. Bhattacharyya ...for the State Ms. Soma Roy Chaudhuri ...for the respondent nos. 2 and 3 Learned counsel for the petitioner submits that the petitioner's grievance is that the bank, despite being approached by the petitioner, has not disclosed particulars about the accounts and transactions in respect of the petitioner's deceased husband with the bank.
Learned counsel for the bank, however, refutes such contention and hands over certain documents disclosing the particulars as sought by the petitioner. It is submitted that the same was communicated to the petitioner as well.
The petitioner controverts such contention.
Be that as it may, since a copy of the particulars, which are handed over to the court, are also served on the learned Advocate for the petitioner here and now, the grievance of the petitioner in the present writ petition does not survive any more.
Accordingly, WPA No. 13164 of 2023 is disposed of with liberty to the petitioner to take appropriate steps with regard to the particulars furnished by the respondent-bank in respect of the transactions of the petitioner's deceased husband with the said bank.
A copy of the papers handed over in court by learned counsel for the bank be kept on record. There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
