Heard learned counsels for the parties.
The petitioner is in custody for more than 300 days and prays for bail.
Learned counsel for the petitioner submits that witness action is yet to commence. Further detention of the petitioner is not required in view of the period of detention of the petitioner.
Learned counsels for the State and the de facto complainant oppose the prayer.
Bail prayer of the petitioner was turned down by this Court considering the material on record on 18th March, 2025. Two eye witnesses as well as the injured witness have implicated the petitioner in the alleged offence. The petitioner along with others assaulted the victims, one of whom succumbed to his injuries. The post mortem report supports the prosecution case. Two of the co accused who
are the sons of the petitioner are still absconding. The petitioner is in custody for about a year. Offence, if proved, shall attract mandatory life imprisonment.
Considering the gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.
The application for bail is thus disposed of. Case diary be returned.
