The petitioners pray for issuance of the death certificate by the Bidhannagar Municipal Corporation, which has allegedly not been issued in favour of the petitioners on account of an application filed by the respondent no. 4 for obtaining the said certificate. Learned advocate representing the respondent no. 4 submits, upon instruction that, as the deceased remained with the respondent no.4 for a considerable period of time prior to his death and as despite intimation given to the petitioners they did not respond to the request of the respondent no. 4 for proceeding with the cremation of the deceased, on the advice of the Corporation, the application for obtaining death certificate was filed by the respondent no. 4.

Learned advocate for the respondent no. 4 categorically submits in Court that he does not have any objection if the death certificate is issued in favour of the petitioners.

In view of the submission made by the respondent no. 4, there may not be any hindrance on the part of the Corporation to issue the certificate of death to the applicant.

Learned advocate for the petitioners is directed to forward copy of the application made for obtaining the death certificate to the Corporation at the time of communicating the order of the Court.

Steps shall be taken to issue the death certificate at the earliest.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
