Learned advocates for the parties have appeared. The application being CAN 1 of 2023 is by the applicant/writ petitioner seeking recall of this Court's earlier order dated May 1, 2023, in WPA 12247 of 2004.

By dint of the said order, the Court had dismissed the writ petition as above, for default due to non-appearance of the learned advocate on behalf of the petitioner.

On perusal of the grounds pleaded by the petitioner in the present application as well as upon hearing the learned advocate for the petitioner, the Court is of the considered opinion that the grounds pleaded are substantive and sufficient.

Hence, the present application being CAN 1 of 2023 be allowed, thereby recalling the Court's order dated May 1, 2023, in WPA 12247 of 2004 and restoring the writ petition in its original file and number.

Let this matter appear in the list immediately under the heading "Old Hearing Matters".
