Chakraborty Mr. Shashanka Shekhar Saha ...... for the petitioner Mr. Saibal Bapuli Mr. Bibaswan Bhattacharya ...... for the State We have considered the materials on record. Statements of witnesses disclose recovery of narcotic substance above commercial quantity i.e. 3 ltrs. of codeine mixture from the possession of the petitioner.

In view of the aforesaid facts and in the light of the statutory restrictions under Section 37 of the N.D.P.S. Act, we are not inclined to grant bail to the petitioner.

The application for bail is thus rejected.
