Zaman ......for the appellants Mr. Srijan Nayak Ms. Subhasree Ghose ......for the SBSEDCL Party/Parties is/are represented in the order of their name/names as printed above in the cause title. This appeal is against an interim order of the Hon'ble Single Bench dated the 24th of August, 2021. The appellants complain of wrongful installation of an electric pole. The appellants submit that such electric pole be removed.

On behalf of the Respondents/West Bengal State Electricity Distribution Company Limited (WBSEDCL), it is submitted that the electric pole in issue has been

placed on an open land and causes inconvenience to none.

Having heard the parties and considering the materials placed, this Court finds that at the interim stage the Hon'ble Single Bench has recorded its observations and reasons in some detail.

This Court is therefore persuaded to take the view that no intervention is required at the interim stage. Parties are accordingly permitted to exchange their Affidavits before the Hon'ble Single Bench as already directed by the solemn order dated 24th August, 2021. The Hon'ble Single Bench is requested, subject to its convenience, to expedite the hearing of the writ petition. Both MAT 946 of 2021 and CAN 1 o 2021 stand thus disposed of.

Since Affidavits are not invited, allegations made in appeal and the application shall be deemed to be denied. All parties to act on a server copy of this order downloaded from the official website of this Court. Urgent certified photocopy of this order, if applied for, will be made available to the parties subject to compliance with all requisite formalities.
