C.R.M. (M) 773 of 2025 In Re : An Application under Section 439 of the Code of Criminal Procedure/under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Chinsurah Police Station Case No. 163 of 2022 dated 04.04.2022 under Section 302 of the Indian Penal Code.

And In Re : Sani Pashi @ Sani Pasi Md. Khairul ... For the Petitioner.

Mr. Rudradipta Nandy Ms. Suchismita Dutta ... For the State Learned counsel for the petitioner submits that the petitioner is in custody for more than 3 years and prays or bail. Learned counsel submits that there is no direct evidence against the petitioner and the defacto complainant has turned hostile. Out of 14 witnesses 7 witnesses have been examined till date.

Learned counsel for the State opposes the prayer. I have considered the material on record.

Bail prayer of the petitioner was turned down on earlier occasions considering the material on record. The petitioner is the husband of the victim lady who was murdered. The dead body was recovered pursuant to the leading statement of the petitioner.

Witnesses have implicated the petitioner in the alleged crime. Offences, if proved, shall attract mandatory life imprisonment.

Considering the gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

However, learned trial Court is directed to expedite the trial without granting any unnecessary adjournments to either of the parties.

The application for bail is disposed of.

Case diary be returned.
