1. The petitioner has preferred the present writ petition seeking direction to the State Information Commission, i.e, second Appellate Authority under the RTI Act, for the expeditious disposal of his Second Appeal preferred on 10.02.2023.

2. Learned counsel for the petitioner submits that he sought certain information under the RTI Act vide RTI application dated 23.11.2022. Finding no response from the said authority, the Petitioner preferred first appeal dated 30.12.2022 before the first appellate authority, West Bengal Central School Service Commission. However, even after the expiry of the statutory period, the concerned first appellate authority neglected to provide any information as sought by the petitioner. Hence, the petitioner preferred a second appeal before the State Information Commission, WB on 10.02.2023. However, the

Second Appellate Authority also failed to consider the petitioner's application.

3. Learned counsel for the respondent, appearing on behalf of the State Information Commission, has brought to the notice of this Court that a notice of hearing for the petitioner's second appeal bearing no. 103946 has already been issued and the matter is scheduled for hearing on 21st October, 2024.

4. In the light of the submissions made by the learned counsel for the respondent, the petitioner no longer wishes to press the present writ petition, subject to the assurance that his second appeal before the State Information Commission shall be disposed of as expeditiously as possible, in accordance with law.

5. After considering the submissions made by both the parties, this Court directs the State Information Commission to ensure that the petitioner's appeal bearing no. 103946 shall be disposed of expeditiously.

6. With the above direction the present writ petition is dismissed as withdrawn.
