09.06.2023 sdas rejected C.R.M.(NDPS) No. 1099 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Baguiati Police Station Case No. 451 of 2021 dated 18.08.2021 under Section 21(c ) of the NDPS Act.

And In Re : Goutam Hazra alias Takla .... petitioner Mr. Angshuman Chakraborty ....for the petitioner Mr. Saryati Datta ...... for the State Heard the learned Counsels for the parties.

We have considered the materials on record. Narcotic substance above commercial quantity was recovered from the petitioner. Trial is at its fag end. Under such circumstances, we are not inclined to grant bail to the petitioner. The application for bail is, thus, rejected.

We request the trial court to ensure the attendance of the police officer for deposition at the earliest. Parties shall communicate copy of the order to the trial court for necessary compliance.
