The petitioner participated in an e-auction for mining lease and was declared to be the highest bidder therein. Letter of intent was issued in favour of the petitioner by the respondent No.5 on 14th January, 2019 and the petitioner was directed to submit Environmental Clearance Certificate besides other relevant documents. The petitioner complains that despite filing an application for obtaining such certificate before respondent No.3, the application has not been considered by the authority till date.

Having heard the submissions made by the learned counsels for the parties and considering the material on record, I dispose of the writ petition with a direction upon the respondent No.3 to consider and dispose of the representation of the petitioner filed on 10th June, 2021

after giving an opportunity of hearing to all the affected parties including the petitioner within a period of two months from the date of communication of this order, in accordance with law.

WPA 13956 of 2021 is disposed of. There will be no order as to costs.

As affidavits not having been invited, the allegations made in this writ petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
