Mr. Mukteswar Maity ... for the petitioner The Court is approached under Article 227 of the Constitution of India, soliciting a direction to ensure expeditious disposal of a Pre-emption matter registered as J. Misc. Case No. 28 of 2018, now pending before the Learned Civil Judge (Junior Division), 1st Additional Court at Contai, Purba Medinipur.

Mr. Maity, learned advocate representing the petitioner submits that the opposite parties have already entered appearance by filing their written statements/objections and the amendment applications have already been disposed of. According to the petitioner, the Misc. Case is otherwise ready for disposal.

The point requires to be addressed by this Court is very short and simple requiring no extensive hearing and in view of the nature of the order proposed to be passed in this case, the Court is of the view that the same may even be disposed of without inviting presence of the opposite parties. Service upon the opposite parties stands dispensed with.

Learned Civil Judge (Junior Division), 1st Additional Court at Contai, Purba Medinipur in J. Misc. Case no. 28 of 2018 is directed to dispose of the pending Misc. Case after disposing of

the interlocutory applications, if any pending, before the Puja vacation of 2022.

The petitioner is directed to make communication of this order to the Learned Court Below as well as to the opposite parties and their learned advocate, so that both parties may come prepared ready for the effective utilization of the dates to be fixed by the Learned Court Below.

With the above directions and observations, the civil revisional application being CO 1550 of 2021 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis upon completion of requisite formalities.
