The petitioner is aggrieved by the fact that the complaint case was instituted in the year 2015 and is presently pending for cross-examination of the first witness. The accused on one ground or the other has been successful in delaying the process of the court for the last nine years. Having regard to the purpose for which the provisions of Section 138 of the Negotiable Instruments Act were incorporated and the manner in which the period of time has been stretched at the instance of the accused/opposite parties, I direct that the learned Judicial Magistrate, 1st Court, Howrah on and from the next date so fixed be pleased to fix one date in a month for the purposes of the present case so that trial of the case (which includes evidence of the prosecution, Section 313 of the Code of Criminal Procedure and evidence of the defence) is concluded by 31.03.2025 and the judgement of the case being Complaint Case No. 1137C of 2015 is delivered by 30.06.2025.

With the aforesaid observations, the revisional application being CRR 2089 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
