The petitioner has filed the present application being CAN 1 of 2025 praying for recalling of the order dated June 25, 2025 wherein this Court has dismissed the writ petition on the ground of non-appearance of the petitioner on call.

Learned counsel for the petitioner submits that the writ petition was dismissed for default on June 25, 2025 and immediately the petitioner has filed the present application on July 11, 2025 for restoration. He further submits that when the matter was called, learned advocate-on-record could not present before this Court as he was engaged any other Court and when the advocate reached to this Court, by that time this Court already passed an order for dismissal.

3. Considered the submission made by the learned counsel for the petitioner, this Court finds that the petitioner has shown sufficient cause for non-appearance before this Court when the matter was called.

4. Accordingly, the order dated June 25, 2025 is recalled.

5. WPA 14319 of 2024 is restored in its original file.

6. CAN 1 of 2025 is disposed of.

7. The writ petition is taken up for hearing with the consent of both the parties.

This Court finds that the petitioner has filed the present writ application with the prayer upon the respondents to comply with the letter issued by the Director of Employment, Government of West Bengal dated February 17, 2022 and the letter dated June 29, 2022 issued by the Employment Officer to the Block Development Officer. The Director of Employment, Government of West Bengal is running their office in the premises of the petitioner and the Director of Employment, Government of West Bengal has taken a decision for shifting of the office to the Government accommodation. Accordingly, the same was forwarded to the Employment Officer. The Employment Officer has forwarded the said letter to the Block Development Officer requesting for necessary arrangement for shifting office of the Director of Employment, Government of West Bengal to the Government accommodation but till date the office has not been shifted.

9. Learned advocate appearing for the State submits that the petitioner has already initiated a civil suit against the respondents and the civil suit is pending for adjudication. He submits that if any order is passed in the present writ application, the same will effect to the civil suit.

10. This Court finds that the petitioner also disclosed in the writ petition with regard to the pendency of the suit filed by the petitioner against the Employment Officer-inCharge.

11. Considering the above, this Court finds that the authorities had already taken administrative decision for shifting of the office of the Director of Employment, Government of West Bengal from the private premises to the Government accommodation but has not been implemented till date.

Accordingly, the authorities are directed to file report on January 8, 2026 with regard to what steps has been taken by the authorities in terms of the Memorandum no. 4A-MISC/2018/661-749A dated February 17, 2022 issued by the OSD and EO, Director of Employment, West Bengal and the communication made by the Employment Officer to the Block Development Officer dated June 29, 2022.

13. Let the report be filed on January 8, 2026 after serving the copy to the learned counsel for the petitioner.
