The second petitioner is the sole proprietor of the first petitioner firm which has been granted licence for LPG retro-fitment for petrol vehicles, such licence being valid till 2nd September, 2024. By a notification issued by the Government of West Bengal, Transport Department on November 5, 2015 Rule 71B was omitted with immediate effect.
Learned counsel for the petitioner submits that despite omission of the said Rule, the petitioners have been informed by the Regional Transport Officer, Suri, Birbhum in reply to an application filed by them under Right to Information Act, 2005 that total number of conversion from petrol to LPG from 5th November, 2022 to 16th February, 2023 is 298. The petitioner prays for a direction upon the concerned authority to take
necessary steps for detection of such illegal conversion and deal with the said vehicles, in accordance with law. It is submitted on behalf of the respondents that the concerned authority is taking necessary steps for detection of such illegal conversion. Six vehicles have already been intercepted and appropriate measures have been taken against them. Learned counsel further submits that steps are continued to be taken in this regard by the authority.
In view of the above, the writ petition is disposed of directing the concerned authorities to take necessary steps for detection of such illegal conversion as referred to above and also take necessary consequential steps against such vehicles, in accordance with law. The writ petition is thus disposed of.
There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
